The current solution is that 5-7 teams will be declared eligible for participation in bowls based on their Academic Progress Rates
The NCAA does not intend to break ties in APR, but rather simply declare both teams eligible and let the bowls and conferences fight it out.
The NCAA has no authority over the contracts that conferences and teams have with the bowl games. Its role is to merely certify that the games can be played and to create a standard for teams to be eligible to participate.
